What Cuchumbo is
Cuchumbo lets an organizer create an exchange, set its date, budget and rules, invite people and run a draw that tells each person whom they give a gift to. The draw is random within the organizer’s rules, and the service is designed so that each person sees only whom they drew.
It is free. Each exchange, with its data, is scheduled to be deleted about six months after its gift day, as the privacy notice explains.
Cuchumbo is not part of the exchange
Cuchumbo is a tool. It is not a party to what the people in an exchange agree among themselves, and it does not buy, sell, deliver, guarantee or insure any gift. It does not answer for whether gifts are bought, delivered or received, for their value or quality, for the budget, dates or rules the organizer sets, or for disagreements between participants.
Signing in and inviting
Participants need no account: the invitation link is enough. Organizers sign in with a one-time link sent to their e-mail address; anyone who gets that link can sign in, so keep the mailbox safe and, if it may have been compromised, sign out of every session and write to us.
Organizers must be adults and invite only people who have agreed to take part and to have their e-mail address used for the exchange. A minor takes part only with the consent of a parent or guardian.
What is not allowed
Inviting people without their consent, sending unsolicited messages, harassing, threatening or demeaning anyone, sharing content that is unlawful, sexual, violent or hateful or that is not yours to share, impersonating someone else, trying to see results that are not yours, or disrupting the service.
Pictures and texts may be checked against these rules, partly by automated means and with the help of service providers. Content that breaks them may be withheld or removed, an exchange may be removed, and repeated violations can get an address refused. Anyone can report content from the page where it appears or by writing to us.
What you write and upload
It is yours, and you answer for it, including any picture that shows other people. You let us store, show and send it only to run the exchange, for as long as the exchange exists. If someone claims against us because of your content, you answer for it.
Gift ideas, shop links and ads
Cuchumbo shows gift ideas, links to online shops and ads served by Google AdSense. As an Amazon Associate, Cuchumbo earns from qualifying purchases. Purchases happen on the shop’s website and under its terms: we do not sell those products and do not answer for their availability, price, quality or delivery, nor for third-party websites and ads.
No guarantees
Cuchumbo is provided as it is. Maintenance, incidents and events beyond our control may interrupt it, and e-mails may be delayed, land in spam or not arrive.
We are not liable for indirect losses. In any case, our liability is limited to what you paid us in the last twelve months, or USD 100 if you paid nothing. None of this limits what the law does not allow to be limited.
Changes and contact
We may update these terms; the current version is always the one on this page, with its date. You can stop using Cuchumbo at any time and ask us to delete an exchange sooner. Questions: privacy@cuchumbo.com.
