The ground rules for using Cuchumbo.

Cuchumbo is a small free tool that helps a group organize a gift exchange. By using it you agree to the terms below; they are short on purpose.

What Cuchumbo is

Cuchumbo is a web service that lets an organizer create a gift exchange, invite players, and run a private draw. The draw is the core feature: assignments are sealed so that only the person who drew a name can see who they drew. The service is currently free of charge.

Accounts and sign-in

Players do not need an account: a one-tap invitation link is enough. Organizers sign in with a one-time link sent to a verified email. Keep that email safe — anyone who receives that link can sign in as you. If you suspect your email has been compromised, sign out of all sessions and contact us.

Acceptable use

Use Cuchumbo to run gift exchanges for people who have been welcomed into the group. Do not invite people without their consent, do not use the service for harassment or to send unsolicited messages, do not attempt to break the sealing of the draw, and do not try to disrupt the service or access data that is not yours. We may suspend accounts that do.

Content you add

Names, hints, and other content you type are yours. You keep all rights to them; we store them only for as long as needed to run the exchange and delete them with the rest of the Cuchumbo. You are responsible for what you write — do not share content that is unlawful or that others have not consented to you sharing.

Availability

We work to keep Cuchumbo fast and reliable, but we cannot guarantee the service will always be available. Maintenance, incidents, or circumstances outside our control may cause interruptions. The service is provided on an "as is" basis, without warranties of merchantability or fitness for a particular purpose.

Liability

To the extent allowed by law, Cuchumbo is not liable for indirect, incidental or consequential damages arising from your use of the service. Nothing in these terms limits liability for gross negligence, willful misconduct, or anything that cannot be limited under applicable law.

Changes to the terms

We may update these terms to reflect product changes or legal requirements. When we do, we update the "last updated" date at the top and, for material changes, we notify organizers by email. Continuing to use the service after an update means you accept the new terms.

Governing law

These terms are governed by Spanish law. Disputes will be submitted to the competent courts of the organizer's place of residence when that resident is a consumer, and otherwise to the courts of Madrid, Spain.
